Voting for the New TA on RE-Vote

Ballots are ready in the Juneau Office, We have designated members to go and meet the ships that are in Juneau.  If you are in RIF, or vacation, or on leave for any other reason, please contact Monique at 790-9644 to have your ballot mailed.  Your vote is very important, please do not let any others persuade you on how to vote and what to vote for, remember this is your future, and to leave your future into the hands of the arbritrator is scary, because what ever he decides, we will have to deal with.

Re-Voting the TA

Dear Brothers and Sisters of the IBU:

 Our recent difficult meetings with the State toward getting to a better TA have lead toward arbitration, with the State's proposal to the arbitrator being far worse that what the TA offered. Furthermore, this would put the fate of our contract issues in the hands of an someone who is not nearly as informed about our concerns as we are. The most recent TA is regarded by your negotiating team to be a better contract alternative, and one that we can count on, rather than sending many issues into the uncertain future of arbitration. As you have heard, based on the many members who did not vote, and have asked for a revote if possible on this last TA, we asked the State for the possibility of re-voting, and have been granted this opportunity to ratify it, provided it happens in a timely manner. This is our best alternative to an uncertain future. The entire negotiating committee and the Regional and National leadership of the IBU urge every member to vote, and to vote “yes” on the TA.
 
Many things have changed since the last TA went out to vote. The big issue, as we all know, is the economy has gone into the toilet, and experts are saying we are headed for a global depression that will be worse than that of the 1930s. Alaska is being affected by oil prices falling to a third of what it was when we negotiated the TA, and the Governor has put out demands for budget cuts in all Departments. This TA is the absolute best that we can hope for in these times. Let’s take this opportunity to lock in the protections of a contract.
 
Even if we went on strike, we are still legally obligated to enter into arbitration, and the arbiter could award less than what we are already offered in this TA. All of us should be aware of how crucial this vote is. Voting against this TA to protect Split wages will only throw that issue and others into the hands of an arbitrator. Regardless of how we vote on our TA, we will never convince the state to drop the accrual rate for new hires after July 2009; current employees will not lose any vacation accrual.  In the interest of protecting our current members from an assault by the State on their maximum vacation accrual, proposals regarding vacation were not opened for arbitration.
 
This has been a very hard negotiation in very hard times. We ask for you to understand that and hear our appeal to vote favorably for the TA this time, so we can all move on.

AMHS Contract Update

In an attempt to present the information in a concise manner, I thought a timeline with bullet points would be helpful to most of you.  Regardless of your personal feelings on the Tentative Agreement, more information will only help you understand the situation we find ourselves in today.

July 17, 2008                                                       TA signed by the parties

 

September 5, 2008                                          TA Ballots mailed to membership, total ballots 607

 

September 12, 2008                                        Complete TA with Supplements posted to membership

 

October 22, 2008                                              TA Ballots counted total ballots counted 273, 106 votes to ratify, 167 against ratification.

 

November 17-18, 2008                                  Return to negotiating table with state.  IBU proposal consisted of previous TA language keeping Rule 7 and Rule 23 as “book” language.  State proposal back to original position, no Split Wages, maintain third Tier Vacation, delete Annual Passes, removal of language allowing the employer to reimburse for receipted expenses while on per diem in Rule 9, Rule 17; $2,137 year one, 3% in years two and three.

 

                                                                                Parties reached a dead end, discussion to move the parties to Interest Arbitration.  IBU attorneys contacted and briefed on AMHS Bargaining Unit’s issues and concerns

 

November 19, 2008                                         Met with state to discuss re-voting previous TA. Parties discussed the parameters and requirements for a re-vote.

 

November 21, 2008                                         Letter of Agreement draft sent to IBU and attorney allowing a re-vote and proposed Ground Rules for Arbitration received from the state

 

November 25, 2008                                         Counter proposal to state’s Letter of Agreement presented

 

December 1-3, 2008                                        Next negotiation session with state, topics tentatively on agenda; ground rules for arbitration, Letter of Agreement to allow IBU re-vote of TA, submitting additional proposals if continuing new contract negotiations, submit “last and best” proposal from IBU

 

December 31, 2008                                         Proposed date for re-vote ballot count

 

January 1-15, 2009                                           Suggested dates for arbitration hearing

 

February 2009                                                   Determination due from arbitrator if arbitration is held

 

March 13, 2009                                                  Last day for any monetary terms to be presented to Legislature requiring them to vote on the terms.
